    Terms & Conditions of Using Riser Vision

    Definitions

  • Riser Vision Mobile App – Software for mobile devices with internet access (e.g., smartphones, tablets) fulfilling the technical requirements determined herein, which may be downloaded by the User from authorized application stores indicated by the Service Provider.

  • Child App – The Riser Vision Mobile App version designed for children's devices, delivering age-appropriate affirmations, spiritual insights, and inspiring stories.

  • App – The Riser Vision Mobile App version for devices used by adults having parental authority/custody over underage persons, used for User Account and Child App management.

  • User Account – Individual account created after registration in the Product, accessible upon submitting login credentials. The User Account contains personal information submitted by the User and enables the User to manage preferences and settings.

  • Child Profile – A profile of an underage person created and registered by the User within the User Account for managing the Child App experience and affirmation settings.

  • Terms & Conditions – These Terms and Conditions of using the Product.

  • Product – A digital product named Riser Vision which consists of the following elements: the Website, the Child App, and the Parent App; enabling access to Services offered and provided via electronic means by the Service Provider in accordance with these Terms & Conditions

  • Website – The internet site available at rise2parent.com and related subdomains.

  • Child's Device – A mobile device with internet access (e.g., smartphone, tablet) on which the Child App is installed, assigned to a given Child Profile created within a User Account.

  • Parent's Device – A mobile device with internet access on which the Parent App is installed, assigned to a given User Account.

  • Service – The services rendered by the Service Provider for Users within the Product, including but not limited to daily affirmations, spiritual insights, and inspiring stories.

  • Service Provider – Rise2Parent Coaching Company registered in the United Kingdom and Nigeria, with primary business address at 27 Kyle Wynd Newton Mearns Glasgow G77 5XJz, Company Registration Numbers:+447515140035 and 08035828195, Company email: [email protected]

  • User – An adult natural person, having legal capacity, who has registered an account in the Service.

  • Child User – An underage person who uses the Child App on Child's Device, whose parent or legal guardian is the User.

  • General Provisions

  • These Terms & Conditions determine the conditions of rendering services available within the Product, including services delivered via the Riser Vision Mobile App and the Website.

  • The Product is intended for parents, guardians, and caregivers who wish to provide their children with daily positive affirmations, spiritual insights, and inspiring stories through a digital platform.

  • The User, before concluding the agreement for providing Service, shall be under obligation to register in the Product and accept these Terms & Conditions. After any applicable free trial period, to continue using services available within the Product, the User is obligated to pay the subscription fee.

  • The User shall be under obligation to observe the provisions hereof and comply with applicable laws in their jurisdiction.

  • Registration and Activation of Services

  • User Account registration is available through:

  • The Website, where users must complete a registration form providing their name, valid email address, and setting up a password

  • The Riser Vision Mobile App (available on iOS and Android), following the same registration process

  • Upon registration, a verification email containing account activation instructions will be sent to the provided email address.

  • successful registration, the Service Provider shall create a User Account assigned to the email and password submitted in the registration form.

  • After the User Account is registered, it must be configured by creating a Child Profile, including:

  • The child's name

  • The child's age/year of birth

  • Preferred affirmation categories and themes

  • Preferred delivery times for daily affirmations

  • Data Protection and Service Provider Obligations

    Data Protection Measures

    The Service Provider is committed to maintaining strict technical and organizational security measures to protect User and Child User data, following all relevant data protection regulations, including the GDPR and the Nigerian Data Protection Regulation (NDPR). These measures include:

  • Encryption and Secure Data Storage: Personal and profile data are encrypted and stored on secure servers with restricted access.

  • Data Minimization and Anonymization: Only essential information is collected and processed, with anonymization applied where possible.

  • Routine Audits and Compliance Checks: Regular audits are conducted to ensure ongoing compliance with data protection laws, adapting to any regulatory changes.

  • User Rights to Access and Delete Data: Users may request access to their or their child’s data, or deletion of data, in compliance with applicable laws.

  • Service Provider Obligations

  • Service Provision Commitment: The Service Provider shall render the Services within the Product as described in these Terms & Conditions, ensuring consistency and quality. The Service Provider guarantees a contract with the User once registration is completed successfully.

  • Contract Validity and User Rights: The contract for Services is effective upon registration and remains active as long as subscription payments are up to date. The User has the right to cancel or terminate the subscription under specified conditions in Section 9.

  • Exclusion of Internet and Telecom Services: The Service Provider does not supply internet or data transfer services and is not liable for connectivity issues or limitations arising from third-party internet service providers.

  • Service Modifications: The Service Provider reserves the right to update or modify the technical method of delivering Services to enhance functionality or security, provided this does not diminish service quality or infringe on User rights. Significant modifications will be communicated via email with advance notice where possible.

  • Scope of Services:

  • Service Offering: The Service Provider will offer the following Services to paying Users, accessible through the Riser Vision Mobile App:

  • Daily Content Delivery: Age-appropriate affirmations, spiritual insights, and motivational stories are delivered daily based on User settings.

  • Customizable Content Management: Tools for customizing content themes, affirmations, and delivery schedules are provided.

  • Progress and Engagement Tracking: Parent Users can monitor Child User engagement with content and track progress.

  • Comprehensive Content and Control: The scope of the Services includes:

  • Tailored Affirmations and Insights: Users can select content categories and themes relevant to their child’s age, maturity, and preferences

  • Delivery Scheduling: Users may specify daily times for affirmation delivery and manage notification preferences.

  • Age-Filtering and Parental Oversight: The app provides content filtering to ensure appropriateness by age, with options for parents to preview and adjust affirmations as desired.

  • User Control and Notifications:

  • Users receive the following notifications:

  • Registration Confirmation: An email confirming account registration.

  • Daily Delivery Confirmations: Emails confirming the successful delivery of affirmations and insights.

  • App and Subscription Updates: Notifications on feature changes, new content, subscription renewals, and other service updates.

  • Technical Limitations and Service Continuity

  • Service Continuity Assurance: The Service Provider will make every reasonable effort to maintain uninterrupted operation of the app, with planned maintenance scheduled during non-peak hours. Users will be notified in advance when possible, especially for extended maintenance periods.

  • Extended Interruptions: If technical interruptions exceed 24 hours due to unforeseen circumstances, the Service Provider will extend User subscriptions by an equivalent period to compensate for the downtime.

  • Exemption for Third-Party and Uncontrollable Disruptions: The Service Provider strives to maintain app compatibility with the latest versions of major operating systems (e.g., iOS and Android). However, the Service Provider cannot guarantee full functionality on older devices or operating systems. Users are responsible for ensuring that their devices meet minimum system requirements. The Product also relies on third-party app stores (Apple App Store, Google Play Store) and internet services. The Service Provider is not liable for disruptions caused by these services, though efforts will be made to provide advance notice of significant issues

  • Usage Rules

    User Responsibilities

    Users agree to:

  • Appropriate Use: Use the Product only as intended, refraining from any actions that may disrupt or compromise its operation, security, or accessibility for others.

  • Accurate Information: Provide and maintain current, accurate information during registration and update any changes promptly to ensure proper account management.

  • Password Security: Keep login credentials confidential, secure, and accessible only by authorized persons. Users are responsible for any actions taken under their account.

  • Content Legality and Appropriateness: Only upload or share content within the Product that is lawful, appropriate for the intended use, and free from offensive, harmful, or copyrighted material

  • Privacy and Respect for Others: Respect the privacy and rights of other users, including avoiding unauthorized access to other users' accounts or data.

  • Timely Payments: Ensure timely payments for subscription services to maintain uninterrupted access.

  • Legal Compliance: Adhere to all applicable laws and regulations in their jurisdiction while using the Product. This includes observing age and data protection laws regarding children and minors.

  • Grounds for Account Suspension or Termination

    The Service Provider reserves the right to suspend or terminate accounts in the following situations:

  • Violation of Terms & Conditions: If Users engage in any actions that violate these Terms & Conditions or attempt to circumvent the Product’s intended purpose, their account may be suspended or terminated.

  • Loss of Parental Authority or Guardianship: If a User loses parental authority or guardianship over a Child User, their access to the Child Profile and related features will be revoked to protect the child’s rights.

  • Unauthorized Installation or Use: Accounts may be terminated if the app is installed on a device without the proper authorization of the User or intended User, especially in cases involving child devices.

  • Harmful or Inappropriate Conduct: The Service Provider may suspend or terminate accounts if a User’s actions pose a risk to the safety, privacy, or experience of other users, including attempts to access restricted content, misuse services, or harass other users.

  • Fees and Subscriptions

    Free Access and Trial Period:

  • Freemium Model: Core content remains free, while premium features are available to subscribers.

  • Referral Program: Users who refer others are eligible for discounts on their subscriptions.

  • Subscription-Based Pricing:

    Monthly Subscription Plans:

  • Basic Plan: ₦3,000/month (or $5 USD) – Includes access to general resources and activities for one child profile.

  • Premium Plan: ₦10,000/month (or $15 USD) – Grants access to personalized content, expert-led webinars, and family coaching sessions, supporting up to 5 child profiles.

  • App Store Subscriptions: Payments for both Basic and Premium subscriptions are processed through the respective platform's payment system (App Store for iOS users, Google Play Store for Android users).

    Additional Revenue Options:

  • One-Time Purchases: Users can buy premium content like webinars, workshops, and downloadable resources (e.g., e-books, parenting toolkits).

  • Corporate Partnerships: The product is available at discounted rates for institutions like schools, community organizations, and religious groups, promoting access to more families.

  • Subscription Terms:

  • Payment Processing: Subscription fees are collected in advance, with billing managed through the App Store or Google Play Store.

  • Auto-Renewal: Subscriptions auto-renew by default unless cancelled through the user’s app store settings.

  • Cancellation: Users can cancel their subscription at any time via the app store settings.

  • Billing History and Receipts:

  • Users can access their billing history and download receipts from their respective app store accounts.

  • Additional Costs:

  • Users are responsible for any additional costs associated with data charges or internet usage while using the app.

  • Contract Term and Termination

  • License Activation: The license to use the Riser Vision Mobile App begins upon installation and remains valid throughout the paid subscription period. Users gain access to features according to their chosen subscription plan, and access is automatically extended upon each renewal.

  • This is a regular list itemUser-Initiated Termination:
    Users may terminate their subscription as follows: During Trial Period: Users may cancel their subscription at any time within the trial period without incurring charges.
    Via App Store: Subscriptions can be terminated through the respective app store settings (Apple App Store or Google Play Store).
     Account Deletion: Users can delete their account within the app, which will also cancel the subscription and end service access.

  • Termination Process:
    Subscription Cancellation: Users should cancel subscriptions directly through the App Store or Google Play. Once the cancellation is processed, no further charges will be made.
    Account Deletion: Deleting the account in the app will remove user data and end access to all content and services.
    Uninstalling the App: Simply uninstalling the app does not cancel the subscription. Users must complete the cancellation process through app store settings or account deletion.

  • Consequences of Account Deletion:
    Deleting an account results in:
    Immediate Service Termination: Access to the Riser Vision Mobile App will cease immediately.
    Data Deletion: User data will be deleted in accordance with our privacy policy, including personal information, preferences, and child profiles.
    No Refunds: In the event of extended technical issues directly attributable to the Service Provider that impact service delivery for more than 14 consecutive days, affected Users may be eligible for a prorated refund or subscription extension at the Service Provider’s discretion.

  • Service Provider-Initiated Termination:
    The Service Provider reserves the right to suspend or terminate access to the Riser Vision app under the following conditions:
    Violation of Terms & Conditions: If a User fails to comply with these Terms & Conditions.
    Extended Payment Lapse: If subscription payments lapse without resolution during the grace period. Platform Misuse: If there is any misuse, unauthorized access, or abuse of the platform.

  • Post-Termination Obligations:
    After termination:
    Data Deletion: All user data will be deleted in accordance with the privacy policy.
    Service Access: The User will lose access to all content, features, and services immediately.
    Refund Policy: No refunds are issued for any unused subscription portions or previously paid fees.

  • Intellectual Property Rights and License

  • License Grant:
    The Service Provider grants the User a paid, non-exclusive, non-transferable license to install and use the Riser Vision Mobile App solely for personal, non-commercial purposes. This license is limited to the duration of the subscription period and automatically terminates upon the end of the contract.

  • Permitted Uses:
    Users may:
    Install on Authorized Devices: Install the app on devices under the User’s control.
    Create Temporary Copies: Make necessary temporary copies for app installation and normal operation. Use for Personal, Non-Commercial Purposes: Access the app exclusively for personal use, refraining from any commercial usage.
    Download Content for Offline Access: Download and store affirmations and stories for offline use within the app only, accessible during an active subscription.

  • Prohibited Uses:
    Users are strictly prohibited from:
    Redistributing or Selling: Redistributing, sublicensing, selling, or transferring the app or its content.
    Reverse Engineering: Attempting to reverse engineer, decompile, or gain access to the app’s source code.
    Creating Derivative Works: Modifying, creating derivative works, or integrating app components into other software.
    Altering Branding: Removing or altering any app branding, trademarks, or copyright notices.
    Using Outside App Environment: Accessing or using any app content outside of the app environment.

  • Content Rights:
    Ownership and Protection: All affirmations, spiritual content, stories, and other materials within the app are owned by the Service Provider or its licensors and are protected by copyright and other intellectual property laws.
    Limited Content License: Users are granted a limited, revocable license to access and view the content solely within the app during an active subscription period.
    Obligation to Delete Downloaded Content: Upon subscription termination or expiration, Users are required to delete all downloaded or stored content in compliance with copyright and license requirements.

  • Responsibility

  • Force Majeure:
    The Service Provider shall not be liable for service disruptions or inability to provide Services due to circumstances beyond reasonable control, including but not limited to natural disasters, power outages, internet disruptions, government actions, or other unforeseen events ("Force Majeure"). In such cases:
    Users will be notified of these events via email or in-app notification when feasible.
    For significant disruptions (exceeding 24 hours), subscription periods may be extended by an equivalent duration to compensate for lost service.

  • Maintenance and Updates:
    Scheduled Maintenance: Regular maintenance is conducted to improve and update the app’s functionality and security. Users will receive advance notice via email or in-app alerts for any planned maintenance that may affect access.
    Emergency Maintenance: In cases of unexpected technical issues requiring immediate attention, emergency maintenance may occur without prior notice to ensure user safety and data integrity.
    Content Updates: New features, improvements, and content updates are generally scheduled during non-peak hours to minimize disruption.

  • Technical Limitations:
    The Service Provider is not responsible for service interruptions or limitations caused by:
    User Device Compatibility: Issues related to the compatibility or performance of user devices, operating systems, or hardware.
    Connectivity and Network Issues: Problems related to internet connectivity, mobile data networks, or third-party network services.
    App Store Limitations: Functionality issues, delays, or unavailability of the app due to thirdparty app store operations.
    Local Restrictions: Usage restrictions or technical limitations imposed by local regulations, network providers, or device configurations.

  • User Accountability:
    Users agree to: Use Content Appropriately: Engage with the app’s content responsibly and avoid inappropriate uses that may harm themselves or others.
    Follow Local Regulations: Comply with all local, state, and national regulations concerning the use of apps, data privacy, and child content usage.
    Protect Account Security: Maintain the confidentiality of their login credentials and avoid sharing access with unauthorized users.
    Supervise Child Users: Ensure appropriate supervision when Child Users are accessing the app and guide them in interpreting the content.
    Provide Accurate Information: Ensure that all information provided during registration and profile creation is accurate and up-to-date.

  • Content Liability:
    The Service Provider is not responsible for:
    Interpretation of Spiritual Content: Users’ personal interpretations of affirmations and spiritual content.
    Individual Responses: Any emotional, psychological, or behavioral responses that individuals may have in reaction to the content.
    User-Modified Content: Alterations made by users to app content that may affect its original meaning or intended purpose.
    Third-Party Claims: Any claims or legal actions arising from misuse, inappropriate sharing, or third-party access caused by user actions.

  • Data Protection

  • User Notifications and Parental Responsibilities:
    Parental Disclosure: By creating a Child Profile, the User explicitly consents to the collection, use, and processing of their child’s data as outlined in this agreement and the Privacy Policy. The Service Provider recommends that Users provide their children with an age-appropriate explanation of the app's purpose, including data use and privacy practices. This promotes transparency and aligns with best practices in child data protection. When applicable, the rights of child users to request data deletion or access will be honored in accordance with local laws.
    Age-Appropriate Privacy Explanations: Parents should communicate the app’s privacy policy and data collection practices in an age-appropriate manner to ensure child awareness.
    Data Collection Transparency: Clear information on data collection practices and usage should be shared with children as part of parental responsibility.
    Parental Consent Verification: By creating a Child Profile, the User confirms their parental authority and provides consent for data collection as outlined in the Privacy Policy.

  • Data Collection Requirements:
    Basic Registration Data: Required information, such as name, email, and age of children, is collected during registration.
    Optional Profile Data: Additional profile details (child preferences for affirmations) are optional and customizable by parents.
    Usage Statistics: Data related to app usage, content engagement, and user preferences may be collected to improve service quality and app functionality.
    Content Preference Tracking: Data on content themes and categories selected by users is collected to deliver personalized content.

  • Data Administration and Protection:
    Data Control: All user and child data is controlled by Rise2Parent Coaching Company, processed according to the Privacy Policy, and compliant with both UK and Nigerian data protection laws.
    Security and Audits: Regular security audits and updates are conducted to protect data and prevent unauthorized access, with stringent measures to comply with GDPR and NDPR standards.
    User Rights and Data Requests: Users may request access, correction, or deletion of their data in accordance with the privacy policy

  • Claims & Support

  • User Rights and Support Access:
    Users have the right to:
    Submit Service-Related Claims: Report issues related to app functionality, billing errors, or service disruptions.
    Report Technical Issues: Report technical problems, bugs, or compatibility issues through support channels
    Request Content Modifications: Request adjustments to content themes or categories, especially if content is deemed inappropriate for the child’s age.
    Appeal Account Actions: Appeal any account suspensions or terminations they believe were incorrectly applied.

  • Claim Submission Process:
    Users may submit claims through the following channels:

    Full Name: The user’s registered name.
    Account Email: The email address associated with the user’s account.
    Issue Description: A detailed description of the issue or claim.
    Supporting Evidence: Relevant screenshots or other documentation, if applicable.
    In-App Support System: Users may also submit claims or requests through the in-app support interface.

  • Support Response Timeline:
    Initial Response: Users will receive an acknowledgment of their claim or request within 24 hours.
    Resolution Timeline: Service-related claims will be addressed and resolved within 14 days, where possible, with status updates provided if additional time is required.
    Priority Support: Premium subscribers are eligible for priority support, receiving faster response times and dedicated assistance.

  • In-App Accessibility: These Terms & Conditions are readily accessible within the Riser Vision Mobile App. Users can review them at any time by navigating to the "Terms & Conditions" section in the app's settings or main menu.
    PDF Version: A downloadable PDF version of these Terms & Conditions is available upon request. Users can obtain this version by contacting our support team at [[email protected]] (mailto:[email protected]).

  • Updates and Changes

  • Notice for Material Changes: The Service Provider will provide a 30-day notice via email and inapp notifications for any material changes to these Terms & Conditions. Material changes may include significant modifications to service offerings, pricing structures, or data handling practices.

  • Immediate Effect for Minor Updates: Minor updates, such as corrections of typographical errors or clarifications, will take immediate effect without prior notice.

  • Email Notification: For significant changes that impact user rights or obligations, users will receive an email notification detailing the nature of the changes and their implications.

  • Effective Date of Changes: Changes to the Terms & Conditions will become effective after the current billing cycle concludes. This ensures that users are aware of and agree to the new terms before they come into effect.

  • Right to Reject Changes: Users have the right to reject any changes to the Terms & Conditions by terminating their subscription and discontinuing the use of the Riser Vision app before the changes take effect

  • Severability

  • Invalid Provisions: If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from these Terms & Conditions.
    Remaining Terms: The validity and enforceability of the remaining provisions will not be affected or impaired by the removal of any invalid, illegal, or unenforceable provision.
    Supremacy of Legal Requirements: In cases where these Terms & Conditions conflict with applicable legal requirements, the latter will prevail to the extent of the conflict.
    Intended Purpose: The interpretation of these Terms & Conditions shall favor the intended purpose and spirit of the agreement, ensuring that the Service Provider’s objectives are upheld to the fullest extent possible.

  • Governing Law

  • Applicable Laws: These Terms & Conditions are governed by and construed in accordance with the laws of the United Kingdom and Nigeria, without regard to their conflict of law principles.
    International Users: Users accessing the Riser Vision app from outside the UK and Nigeria are subject to the local laws and regulations of their respective jurisdictions.
    Dispute Resolution: Any disputes arising out of or in connection with these Terms & Conditions shall be resolved through the appropriate courts in the UK and Nigeria, depending on the user’s location.
    Mediation Before Litigation: The parties agree to attempt mediation for a minimum of 30 days from the date the dispute is formally raised before initiating any formal legal proceedings. Mediation will be conducted in the User’s local jurisdiction, if possible, to foster amicable settlements.

  • Language

  • Authoritative Language: The English version of these Terms & Conditions is the authoritative version. In cases where translations are provided, the English text will prevail in the event of any discrepancies or conflicts between versions.
    Translations for Convenience: Translations of these Terms & Conditions into other languages are provided solely for user convenience. The Service Provider does not guarantee the accuracy of these translations and is not responsible for any discrepancies that may arise.
    Local Language Requirements: Where local laws mandate the availability of Terms & Conditions in a specific language, the Service Provider will comply by providing an accurate translation upon user request.
    Preferred Communication Language: All official communications, including notifications about updates or changes to the Terms & Conditions, will be conducted in English. Users are encouraged to communicate in English to ensure clarity and consistency.

  • Additional Provisions

  • Right to Modify Terms: The Service Provider reserves the right to modify or update these Terms & Conditions as necessary to reflect changes in the Product, laws, or business practices.
    Notification of Changes: Users will be notified of any significant changes to these Terms & Conditions via email or in-app notifications at least 30 days before the changes become effective, allowing users time to review and, if desired, terminate their subscription.
    User Acceptance of Changes: By continuing to use the Product after changes take effect, Users agree to be bound by the updated Terms & Conditions. Users may decline changes by terminating their subscription before the updated terms apply

  • Assignment

  • Service Provider’s Right to Assign: The Service Provider may assign, transfer, or delegate its rights and obligations under these Terms & Conditions to a third party without prior notice or consent from Users, provided that such assignment does not reduce Users’ rights under this agreement.
    User Restrictions on Assignment: Users may not assign or transfer their rights and obligations under these Terms & Conditions to any other individual or entity without prior written consent from the Service Provider.

  • Entire Agreement

  • Comprehensive Agreement: These Terms & Conditions, including any incorporated documents, constitute the entire agreement between the User and the Service Provider concerning the use of the Riser Vision Product and supersede all prior or contemporaneous agreements, understandings, representations, and negotiations, whether written or oral.
    Amendments and Modifications: No amendment, modification, or waiver of any provision of these Terms & Conditions shall be valid unless made in writing and signed by authorized representatives of both parties, except as otherwise provided herein.

  • No Waiver

  • Non-Waiver of Rights: The failure of the Service Provider to enforce any right or provision of these Terms & Conditions shall not constitute a waiver of that right or provision.
    Preservation of Rights: Any waiver of rights by the Service Provider must be made in writing. A waiver of any one instance shall not constitute a waiver of any future instances or other rights under these Terms & Conditions.

  • Identification of Parties:

  • Service Provider: The term “Service Provider” refers to Rise2Parent Coaching Company, responsible for offering the Riser Vision Product.
    User: The term “User” refers to any individual with a registered account, including parents, guardians, or caregivers, who accesses or utilizes the Product and its services. Child Users, who access content under a parental account, are also included under the User’s responsibility.
    Third-Party Rights: These Terms & Conditions do not confer any rights or benefits to third parties unless expressly provided. All rights, privileges, and protections afforded under this agreement apply solely to the Service Provider and the User.
